These Terms of Service ("Terms") govern your use of the green building automation platform operated by Harshz Technologies Private Limited ("Harshz", "we", "us") at harshz.com and its sub-domains. By accessing or using the platform, you agree to be bound by these Terms.
1. Eligibility
You must be at least 18 years old and legally capable of entering a binding contract under Indian law to use this platform. By registering, you represent that you meet these requirements.
2. Account Registration
You agree to provide accurate, complete information during registration and to keep your credentials confidential. You are responsible for all activity that occurs under your account. Notify us immediately at contact@harshz.com if you suspect unauthorized access.
3. Permitted Use
The platform is licensed for lawful use in connection with GRIHA, IGBC, and other green building certification workflows. You may not:
- Reverse-engineer, decompile, or attempt to extract the source code of the platform
- Use automated scripts to scrape or overload the platform
- Resell or sublicense access to the platform without written consent
- Use the platform for any unlawful purpose
4. Subscription and Payments
Paid plans are billed in advance on a monthly or annual basis. Prices are displayed on the Pricing page in Indian Rupees (INR) inclusive of applicable taxes. Payments are processed securely by our payment partners. See our Refund & Cancellation Policy for details on cancellations and refunds.
5. Intellectual Property
The platform, its interface, code, and all original content are the exclusive property of Harshz Technologies Private Limited, protected under Indian and international copyright and trademark law. Your project data remains yours — we claim no ownership over content you create.
6. Disclaimer of Warranties
The platform is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the platform will be error-free, uninterrupted, or that outputs will guarantee certification approval. Certification decisions rest solely with the relevant rating authorities (ADaRSH/TERI for GRIHA; IGBC for IGBC ratings).
7. Limitation of Liability
To the maximum extent permitted by law, Harshz Technologies Private Limited and its founder shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the platform, even if we have been advised of the possibility of such damages. Our total liability shall not exceed the amount paid by you in the 3 months preceding the claim.
8. Governing Law & Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts of India.
9. Changes to Terms
We reserve the right to modify these Terms at any time. Continued use of the platform after changes are posted constitutes acceptance of the revised Terms. We will notify you of material changes via email.
